By accessing or using the website located at thesonoranstandard.com (the "Site") or purchasing any product from The Sonoran Standard ("we," "us," "our," "The Sonoran Standard," operated as a sole proprietorship in the State of Arizona), you ("you," "customer," "user") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Site or purchase our products.
We reserve the right to update or modify these Terms at any time without prior notice. Changes are effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
The Sonoran Standard is a sole proprietorship based in Apache Junction, Arizona, selling native seed products and wildlife habitat products (including but not limited to seed kits, seed mixes, nest boxes, and related accessories) via this Site and through wholesale accounts with third-party retailers.
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on this Site. By placing an order, you represent that you meet this requirement, or that you are purchasing under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
4.1. We make reasonable efforts to accurately describe our products, including species composition of seed mixes, sourcing, and materials used in nest boxes and other habitat products. However, we do not warrant that product descriptions, photographs, or other content on the Site are accurate, complete, current, or error-free.
4.2. Product availability, pricing, and specifications are subject to change without notice. We reserve the right to limit quantities, discontinue products, or refuse any order at our sole discretion.
4.3. Colors, textures, and finishes (particularly of wood products such as nest boxes) may vary from photographs due to the natural variation of materials such as reclaimed or beetle-kill pine, and due to differences in device displays.
This section is important. Please read it carefully before purchasing seed products.
5.1. No germination guarantee. Seed germination, plant growth, and establishment success depend on factors entirely outside our control, including but not limited to soil composition, moisture, timing of planting, weather, temperature, elevation, pests, wildlife interference, and buyer handling and care after purchase. We do not guarantee that any seed will germinate, grow, flower, or otherwise perform in any particular way.
5.2. Regional and seasonal suitability. Our seed mixes are curated for general Sonoran Desert and Arizona growing conditions but may not be suitable for every microclimate, soil type, or planting season. It is the buyer's responsibility to research suitability for their specific location prior to purchase and planting.
5.3. No agricultural, medicinal, or consumption use. Our seed products are sold for ornamental landscaping, habitat restoration, and wildlife-support purposes only. They are not intended for human or animal consumption, and we make no representation regarding edibility or safety for consumption of any plant grown from our seed.
5.4. Invasive species and local regulations. It is the buyer's sole responsibility to confirm that any species purchased is legal to plant, not classified as invasive or restricted, and appropriate for their county, state, or country prior to planting. We are not liable for any consequences arising from planting in a jurisdiction with restrictions we were not informed of at the time of sale.
5.5. Due to the nature of seed products, all sales of seed products are final except as required by applicable law or as expressly stated in Section 9 (Returns and Refunds) below.
6.1. Nest boxes and related wildlife habitat products are designed with reference to publicly available guidance (including sources such as NestWatch/Cornell Lab of Ornithology) regarding species-appropriate dimensions and placement. However, we do not guarantee that any wildlife species will use, nest in, or otherwise inhabit any product purchased from us. Wildlife behavior is unpredictable and influenced by many factors outside our control, including location, habitat quality, predators, and regional wildlife populations.
6.2. Buyers are solely responsible for installing nest boxes and related products in a safe and structurally sound manner (e.g., proper mounting to poles, trees, or structures) and in compliance with local ordinances, HOA rules, and applicable wildlife regulations. We are not responsible for property damage, personal injury, or wildlife harm resulting from improper installation, mounting, placement, or maintenance of any product.
6.3. Products are handmade or hand-finished from natural materials (including reclaimed or salvaged wood) and may contain natural variations, minor imperfections, or small amounts of residual sawdust, sap, or finish. These are characteristics of the material, not defects.
6.4. Products are intended for outdoor use as designed. We are not responsible for deterioration due to normal weathering, UV exposure, or extreme conditions over time.
7.1. You agree to use the Site only for lawful purposes and in accordance with these Terms.
7.2. You agree not to: (a) use the Site in any way that violates applicable law; (b) attempt to gain unauthorized access to the Site, our systems, or related networks; (c) use automated means (bots, scrapers) to access the Site without our prior written consent; (d) interfere with or disrupt the operation of the Site; or (e) use the Site to transmit any harmful code.
7.3. All content on the Site — including text, graphics, logos, product photography, artwork, label designs, and the "The Sonoran Standard" name and branding — is the property of The Sonoran Standard or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent.
8.1. All prices are listed in U.S. Dollars and are subject to change without notice. Applicable sales tax (Arizona Transaction Privilege Tax, where applicable) will be added at checkout.
8.2. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product description, or suspected fraudulent activity. If your order is canceled after payment, you will receive a full refund of the canceled amount.
8.3. Order confirmation does not guarantee product availability. In the event a product becomes unavailable after an order is placed, we will notify you and issue a refund or offer a substitute at your discretion.
8.4. Payments are processed through third-party payment processors (e.g., Square). We do not store your full payment card information. Use of third-party payment processing is subject to that provider's own terms and privacy policy.
9.1. Shipping timelines provided on the Site are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs (for any international shipments), or other events outside our control.
9.2. Risk of loss and title for products purchased pass to you upon our delivery to the shipping carrier. Claims for items lost or damaged in transit should be directed to us promptly so we can assist with a carrier claim, but we do not guarantee replacement or refund for carrier-caused loss or damage beyond what the carrier's insurance or policies provide.
9.3. It is the buyer's responsibility to provide a complete and accurate shipping address. We are not responsible for orders shipped to an incorrect address provided by the buyer.
10.1. Nest boxes and non-perishable habitat products: May be returned within 14 days of delivery if unused and in original condition, at buyer's expense for return shipping, unless the item arrived defective or damaged, in which case contact us at jake@thesonoranstandard.com within 14 days of delivery.
10.2. Seed products: Due to the nature of these products, seed products are not eligible for return once shipped, except where the product received was materially different from what was ordered, or was defective at the time of shipment (e.g., damaged packaging affecting seed viability upon arrival). Claims must be made within 14 days of delivery with photo documentation.
10.3. We do not offer refunds based on germination results, plant performance, or wildlife use of habitat products, as these outcomes are outside our control (see Sections 5 and 6).
10.4. Approved refunds will be issued to the original payment method within 5-10 business days.
11. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PRODUCTS WILL MEET YOUR REQUIREMENTS, THAT SEEDS WILL GERMINATE OR PLANTS WILL GROW, THAT WILDLIFE WILL USE ANY HABITAT PRODUCT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SONORAN STANDARD, ITS OWNER, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF CROPS OR PLANTS, PROPERTY DAMAGE, OR PERSONAL INJURY, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED FROM US, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless The Sonoran Standard, its owner, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Site or any product purchased; (b) your violation of these Terms; (c) your installation, placement, or use of any nest box or habitat product; or (d) your planting or use of any seed product, including in a manner inconsistent with these Terms or applicable local regulation.
Products purchased through wholesale or third-party retail partners are also subject to that retailer's own policies regarding returns, refunds, and customer service. These Terms govern purchases made directly through this Site.
15.1. These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles.
15.2. Any dispute arising from these Terms or your use of the Site or products shall be resolved exclusively in the state or federal courts located in Maricopa County or Pinal County, Arizona, and you consent to the personal jurisdiction of such courts.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Sonoran Standard regarding your use of the Site and purchase of products, and supersede any prior agreements.
